COUNCIL GROVE LAKE PARK RULES AND REGULATIONS

This booklet is a compilation of various rules and regulations adopted by the governing body regulating the Council Grove Lake Park. This booklet is not intended to fully recite any and all ordinances, leaseholder requirements, rules or regulations, which may be applicable to the Council Lake Park and its users. Any person may review a copy of the city ordinances at City Hall. The enclosed lease agreement details leaser responsibilities. Additional information is also listed in the booklet. Section 1. Rules and Regulations are set out herein concerning a tract of land known as the Council Grove Lake Park, which was established when the City of Council Grove constructed a dam across Canning Creek, creating a lake.

Section 2. ANNUAL INSPECTION: A regular inspection shall be made by the governing body and/or the lake committee of such governing body and they shall be and are vested with authority to make such requirements pertaining to cottages and cabins on lake sites such as general maintenance, painting, general appearance, etc. In the event an owner fails to comply with any rules, regulations or requests made by said committee, the governing body may cancel or refuse to renew such lease. If on the inspection it shall be determined that a construction upon said cabin site did not comply with the original plans, the owner may be directed to meet the specifications of their plans as the same were approved or have their lease and permit cancelled.

Section 3. SKIING AND SURFBOARDING: Skiing and surfboarding are prohibited in areas where speed is controlled or during the hours between sunset and 8:00 a.m.

Section 4. BOAT LICENSE: All State laws pertaining to the operation of watercraft are applicable at the Council Grove City Lake. Persons desiring to keep, have, or maintain any boat upon the lake shall make application for a license from the City Clerk. The City Clerk shall issue such license. If the licensee must purchase a replacement license they will be able to purchase it from the City Clerk for a fee of one dollar and fifty cents ($1.50).

Boat stickers shall be placed on the starboard (right) side of the watercraft, above the water line.

Section 5. BOAT RESTRICTIONS: No person shall make an application for a boat license unless said boat is seaworthy, equipped with safety equipment as provided by state law, balanced, manageable and not likely to capsize, leak or damage other boats upon said lake. Said boats are to have sufficient buoyancy when loaded to capacity. The burden of making such representation is upon the owner or owners of said boat and not upon the City.

Section 6. BOAT FEES: The boat fees shall be based on a graduated scale on the horsepower of motors used to propel boats or other criteria. Fees for residents are as shown below. Residents are defined as persons living and residing within the city limits, individuals outside the city limits that are city water customers, in addition, persons having a cabin upon the Council Grove Lake Park.

$5.00 per year for vessels, sailboats and motor boats with a motor up to an including 50HP
$10.00 for boat with motor from 51 to 100 HP
$15.00 for boat with motor from 101 to 150 HP
$20.00 for boat with motor from 151 to 200 HP
$25.00 for boat with motor from 201 HP on up.
$20.00 for Jet Skis.

Section 7. BOAT FEES; NON-RESIDENTS:

$10.00 for boat with motor up to 50 HP
$20.00 for boat with motor from 51 to 100 HP
$30.00 for boat with motor from 101 to 150 HP
$60.00 for boat with motor from 151 to 200 HP
$75.00 for boat with motor from 201 hp on up.
$60.00 for Jet Skis.

Section 8 . VIOLATIONS: The City reserves the right either by its governing body or by any one of its police officers at the Lake to suspend for any period of time or to revoke any license because violation of this article or for careless or reckless operation of any boat or for any other good cause. Any person whose license is suspended or revoked shall have such license restored only upon application to and approval by the governing body.

Section 9. BOATING RULES: Boats, when meeting shall turn to the right and when overtaking another shall pass on the left, and when their courses are converging, the operator of the boat on the left shall yield the right-of-way to the boat on the right. No watercraft shall maneuver in small circles, nor stop or turn sharply, except in case of emergency, to pick up a fallen skier or to retrieve someone from the lake. All watercraft, which create a wave, will be operated counterclockwise in the main body of the lake inside the area well demarcated by buoys.

Section 10. UNLAWFUL ACTS: It shall be unlawful to operate any boat at such speed or in such a manner as to endanger the life of any person or tend to cause such boat to capsize, wreck or collide with any vessel, motor boat or sail boat or to cause or permit gasoline or oil to be spilled upon or placed or permitted to run in the water in Council Grove City Lake.

Section 11. BOAT SPEEDS: It shall be unlawful to operate a boat on the lake so as to create wake under the following conditions:

a. where speed boating is forbidden as indicated by markers buoys or other signs:
b. after sunset and before 8:00 a.m.
c. between dates of October 30 through April 15.

No boat shall be operated in a manner to imperil or deliberately annoy fishermen or anchored boats.

Section 12. UNLOADING BOATS: All parties not owning cabin sites shall use the boat ramp for unloading and reloading all boats.

Section 13. FISHING REGULATIONS: All persons fishing in the Council Grove City Lake are required to have a state license to fish.

Section 14. FISHING LICENSE: Each person fishing in the Council Grove Lake must, on demand exhibit their state license and catch to any sheriff, police officer, Wildlife and Parks warden or any person in authority, including the caretaker at the lake.

Section 15. FISHING ACTS UNLAWFUL: Fishing with trotline, throw lines, limb lines, and bank-lines is forbidden. Unattended fishing lines by licensees and their guests from their private docks is permitted if tagged securely and plainly with the fisherman’s name and address.

Section 16. CRAPPIE: It is unlawful for any person by fishing or by any other means to keep, remove, destroy, or kill, more than 20 crappie in one day.

Section 17. BASS LENGTH LIMIT: Bass less than 13” and over 18” in total length may be maintained in the possession of the person legally catching the same. All black bass, large mouth bass or spotted Kentucky bass caught in this protected length must be returned to the water immediately. The legal length as set forth herein shall be measured from the tip of the snout to the end of the tail, with the mouth closed and the tail lobes pressed together. Creel limit 5.

Section 18. CHANNEL CATFISH: Length limit: none; creel limit 5.

Section 19. WALLEYE: It is unlawful for any person by fishing or by any other means to keep, remove, kill or destroy walleye, under eighteen (18”) in length from the Council Grove Lake Park.

Section 20. HUNTING REGULATIONS: No hunting or trapping is permitted on the Council Grove Lake Park or grounds. Absolutely no firearms, BB guns, pellet guns, etc. can be discharged on City Lake property.

Section 21. BURNING: A permit must be obtained from City Hall in order to burn yards or limbs on the Council Grove Lake Parks.

Section 22. QUIET HOURS: There is to be “quiet hours” upon the Lake Park from 11:00 p.m. to 7:00 a.m. The term “quiet hours” is defined as a time when no loud music, no loud boisterous talking, no yelling, no indecent or vulgar language is allowed, used, practiced, or any other noise calculated to disturb or annoy any person residing in the vicinity.

Section 23. LAW ENFORCEMENT OFFICER: The Lake Caretaker and part time officer has the authority to enforce city ordinances, rules and regulations as designated by the city council.

Section 24. EASEMENT RESERVATION: The City of Council Grove has an easement and right for ingress and egress to the lake and the lake frontage. This easement is to be five (5) feet width on each side of all cabin licenses granted by the City of Council Grove.

Section 25. SEVERABILITY: If any provision of this code is declared unconstitutional or the application thereof to any person or circumstance is held invalid, the constitutionality of the remainder of the code and the applicability thereof to other persons and circumstances shall not be affected thereby.

Section 26. LEASH ORDINANCE: The City Lake has a leash ordinance. Dogs must be on a leash or on the leaser’s property.

Section 27. BOAT SAFETY; LIFE PRESERVERS: All children 14 years of age and younger must wear coast guard-approved life preservers when a boat is in use upon the waters of the Council Grove City Lake. All skiers and surfboard riders must wear coast guard-approved life preservers. All persons over 14 years of age are not required to wear life preservers when upon the waters of the Council Grove Lake Park, but are to have available approved coast guard life preservers for each occupant of the boat.

Section 28. BOAT OPERATORS AGE: It shall be unlawful for any person under 12 years of age to operate a boat upon the Council Grove Lake unless accompanied and under the direct supervision of a parent or other person over 17 years of age.
